Abstract
Why, you might ask (and my colleagues certainly are), does an intellectual property lawyer use an occasion like this to speak of globalisation and what may seem the internationalist cant of the lunatic fringe? Part of the reason is tied up with just missing out on conscription to the Vietnam war and how it galvanised my ideas about patriotism. Other parts derive from my sense of community, having lived almost a third of my life in different parts of the world. Other parts of the reason relate to what first attracted me to intellectual property law some twenty years ago. Essentially it was the high public international law content of the subject. International law struck me as more legitimate than domestic law, not because it was democratically formed, often to the contrary, but rather it implicitly conceived of a supranational public interest…
