Abstract
As quickly as the public’s attention was drawn to the issue of ‘climate change’, ‘climate change litigation’ has been acknowledged as an emergent body of law in its own right. In the short time climate change litigation has been available to plaintiffs and applicants for review; it has already contributed to achieving sustainable development, the overarching objective of environmental legal systems. It is evident from recent case law and legal scholarship however, that even with a strong plaintiff and a weak defendant, the prospect of a successful public interest claim is limited.
